Hey Clyde,
I found the law on West Virginia ginseng.

Summary:

Digging ginseng/sanging in West Virginia is still legal but with some new rules.

The season is: Sept 1 - Nov 30

Plants must have 3 prongs or more with at least 15 leaflets.

You must sow the berries/seeds where you dig the plant.

During the digging season landowners may dig Ginseng on their own land or give written permission to others to dig on their land. Digging without written permission on posted or enclosed land is a criminal act and subject to fines and imprisonment.

NOTE: It's just my guess, but I think "sang" will bring about $400/lb this year...best to ya

I would check with someone from Forestry first. The news release I read stated it was a federal law that supercedes WV laws and that our Forestry officials were caught off guard when it was passed.

They had just came out with the "new" WV laws on it and thought they would be a standard for other states to follow.........until they saw the new rules the US Fish & Wildlife came up with.
